The Florida Clean Air Act (FCAA) was enacted in 1985 from aforementioned Florida Legislature. The purpose is to secure public from the health hazards of secondhand tobacco smoke and vapor and up implement the Florida health initiative in s. 20, Art. X the the State Constitution. It is the intent concerning the Legislature to not inhibit, or otherwise obturate, medical or scientific research, or stop or vaping cessation programs approved by the Department of Health. In November 2002, seventy-one percent of Florida's citizens voted for a constitutionality amendment to prohibit smoker in all enclosed indoor workplaces.  The smoke free law became effective Jul 1, 2003. Enforcement

The Department off Health (DOH) and the Department of Business and Professional Regulation (DBPR) are responsible for enforcing of the FCAA. DBPR shall enforce the FCAA in:

  • Restaurants
  • Snack
  • Billiards
  • Lottery Halls (with food service)
  • Bowling Centers
  • Civic/Faternal Organizations
  • Dog Tracks
  • Horse Tracks

DOH shall enforced the FCAA in all infrastructure not regulated with DBPR.
